Welcome to Incant. These Terms of Service ("Terms") govern your use of the Incant application ("App") and website, operated by Arcane Lens, LLC ("we," "us," or "our").
By downloading, accessing, or using Incant, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. The Service
Incant is a utility tool for tabletop role-playing games that uses on-device microphone access to transcribe audio and provide real-time information.
- No Accounts: You do not need to create an account to use the App.
- Local Processing: All audio processing is performed locally on your device. We do not transmit or store your audio on our servers.
2. Intellectual Property
- Arcane Lens Rights: The design, code, interface, and original artwork of Incant are the proprietary property of Arcane Lens, LLC.
- Open Game License (OGL): This App utilizes system reference materials provided by Wizards of the Coast LLC under the Open Game License v 1.0a ("OGL"). We make no claim of ownership over the Systems Reference Document (SRD) 5.1 content. Incant is not affiliated with, endorsed by, or sponsored by Wizards of the Coast.
3. Subscriptions & Billing
Incant offers a free tier (the Archives) and a paid tier (the Oracle). The Oracle is sold as an auto-renewable monthly or annual subscription, or as a one-time lifetime purchase that does not renew.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Apple App Store: All payments, subscriptions, and billing are handled directly by Apple. Arcane Lens does not process or store your credit card information. You can manage or turn off auto-renew in your Apple ID Account Settings at any time after purchase.
- Universal License: A single subscription is valid across supported Apple devices (iOS, iPadOS, macOS) logged into the same Apple ID.
- Cancellations & Refunds: You may cancel your subscription at any time via your Apple ID settings. Refund requests must be submitted directly to Apple; we do not have the ability to issue refunds.
4. User Conduct
You agree to use the App only for lawful purposes. You agree not to:
- Reverse engineer, decompile, or disassemble the App.
- Use the App to infringe upon the intellectual property rights of others.
5. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Arcane Lens disclaims all warranties, whether express or implied. We do not guarantee that the audio transcription will be error-free or that the App will function without interruption. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
6. Limitation of Liability
To the fullest extent permitted by law, Arcane Lens, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.
7. Apple-Mandated Provisions
- Maintenance and Support: Arcane Lens, LLC is solely responsible for providing any maintenance and support services for Incant. Apple has no obligation to provide any maintenance or support services.
- Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right to enforce these Terms against you.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Governing Law
These Terms shall be governed by the laws of the State of Texas, United States, without respect to its conflict of laws principles.
